Terms and Conditions – Training Services

The Agreement

The written correspondences and online form submissions between you (the “client”) and Measurelab Ltd. (the “trainer”, “Measurelab”), together with these terms and conditions, constitute The Agreement between the parties involved, for the trainer to provide training services to the client.

This Agreement shall be subject to the laws of England and Wales. Nothing in these terms and conditions will reduce your rights under current UK law (including statutory rights) relating to the supply of unsatisfactory services.

These Terms and Conditions set out the general terms that will apply to Measurelab’s Training Services we provide to you, both remote and in-person.

Cancelling or Rescheduling

Measurelab reserves the right to cancel a course at any time without liability. In these circumstances, delegates will be offered an alternative date. Measurelab will not be liable for any expenses incurred.

If the Consumer Protection (Distant Selling) Regulations 2000 apply, you shall have the right to cancel this Agreement without any liability within 7 days of the Agreement, provided that Services have not commenced and are not due to commence in this period.

The following fees plus VAT below shall apply to the cancellation or rescheduling of any course by you:

Substitutions

You may substitute attendees by written notification to Measurelab with the substitute’s full name and email address. Please note transfer/name changes may not be possible within 24 hours of the course commencing.

Limitation of liability

Measurelab will not be responsible for any commercial or business losses (including without limit loss of goodwill, profits, contracts, anticipated savings, data, or wasted expenditure) or any other indirect or consequential loss, as a result of providing the training service. Nothing in the foregoing shall limit Measurelab’s liability for death or personal injury or as otherwise required by law.

Indemnity

You agree to indemnify (and to hold Measurelab and any of Measurelab’s officers, employees and agents) from and against all and any expenses, losses, liabilities, damages, costs or expenses incurred or suffered and any claims or legal proceedings which are brought or threatened, in each case arising from your use of the services and/or your breach of these terms and conditions.

Complaints and course guarantee

All complaints and claims relating to Measurelab’s Training Services must be received in writing to training@measurelab.co.uk within 14 days of the course completion date. If the claim is requesting a replacement course then the replacement course must occur within 90 days of the original course date.

Data and Privacy Legislation

In order for Measurelab to communicate with attendees, we collect and use individual email addresses and names. This information is required to do business with you, the client, as well as follow up with attendees.

Each Party agrees that, in the performance of their respective obligations under this Agreement, they shall comply with the provisions of the Data Protection Legislation. The expressions “processing”, “Personal Data”, “Data Processor”, “Data Controller” and “Data Subject” shall bear their respective meanings referred to in the Data Protection Legislation. Data Protection Legislation shall include all applicable data protection and privacy legislation in force form time to time in the UK including the UK GDPR (has the meaning given to it in section 3(10) (as supplemented by section 205(4)) of the DPA 2018.), the Data Protection Act 2018 (DPA 2018)  (and regulations thereunder) and the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended.

Lack of online access

Measurelab shall use reasonable means to ensure that the online availability in respect of the course platform is available at all times. However, Measurelab gives no undertakings or guarantees that its site and/or the platform through which the courses are provided will be available and error free at all times and Measurelab shall not be held responsible for any loss, disruption of or interruption in your participation in the course and any damage or loss resulting thereof caused either by any technical error with its site and/or any other website and/or by your computer and/or as a result of a disruption of your access to the internet.

Measurelab is not responsible for technical support of any external websites and where you are required to use external websites in connection with the course, you are required to contact the support services of those external websites directly.

Plagiarism

You agree not to reproduce, duplicate, copy or re-sell any part of our content.
